Transaction Fees, Duties, Customs, & Taxes

1. Transaction Fees

Transaction fees apply to online payments for added security, and to ensure Buyer's and Seller's protection. Payments can be made via credit card, bank transfer, or other methods. Transaction fees, averaging 3.5%, are applied to cover processing costs, and are passed on to the customer using this service. For payments under $1500, these fees remain more cost-effective than many bank transfers.

2. Taxes, Customs, and Duty Fees

2.1 Local Orders: Orders within the province of Québec, Canada, will incur TPS and TVQ charges, already included in the total.

2.2 Canadian Orders: All orders within Canada will be subject to TPS charges, already included in the total.

2.3 USA Orders and Customs Regulations: Orders to the USA are considered exports, thus not subject to taxes. Due to the Free Trade agreement, no customs fees or special taxes apply to our products manufactured in Canada. Generally, receivers aren't required to pay import duties or local taxes, though local sales tax might apply occasionally for orders under $10,000.

2.4 International Orders and Customs Regulations (excluding USA): International orders are also treated as exports, exempt from taxes. However, local sales tax imposed by your country's customs authority will be applicable. Businesses can usually deduct sales tax, while individuals need to pay local tax in addition to the item's price before shipment.

2.5 Russian Federation Orders and Regulations: Russian orders must be shipped to a business address due to Russian regulations. Shipping to personal addresses is prohibited and could result in return fees at the customer's expense. Ensure your business name and address are provided for smooth import. Individuals without a business address can't receive orders in Russia.

3. Product Liability Disclaimer

3.1 Terms of Use, Warranty & Liability Waiver

By adding products to your cart or making a purchase, you acknowledge and agree to the following terms, conditions, obligations, use, warranty, and limitation of liability. These terms are applicable without modification.

3.2 Obligations

CircusConcepts products are designed for specific purposes and should only be used by trained individuals under proper supervision.

3.3 Use

CircusConcepts products are intended for properly trained participants and should be installed, maintained, and used according to provided instructions and recommendations. Users must have the appropriate qualifications and training.

3.4 Warranty

Products are warranted for one year against manufacturing defects, provided they are used, transported, and stored under recommended conditions. CircusConcepts reserves the right to assess warranty compliance.

3.5 Limitation of Liability

The use of circus props carries inherent risks. CircusConcepts and its affiliates cannot be held responsible for injuries, death, or property damage due to the use or misuse of products. Users are accountable for checking the product's condition before each use. Once items are handed over to the carrier, responsibility shifts from CircusConcepts.

4. User Representations and Warranties

By using our products, you represent and warrant that you possess the necessary qualifications, training, and authorization to use the products responsibly and in accordance with our instructions.

5. User Indemnification

You agree to indemnify and hold CircusConcepts inc., its employees, agents, and affiliates harmless from any claims, liabilities, damages, losses, or expenses, including legal fees, arising from your use or misuse of our circus props, or your failure to ensure that the products are used by individuals with the correct formation and training.

6. Modifications and Notices

We reserve the right to modify, amend, or update these terms and conditions at any time. Changes will be effective upon posting on our website. It is your responsibility to review these terms periodically. By continuing to use our website and purchasing our circus props, you acknowledge that you have read, understood, and agreed to these terms and conditions.

7. Intellectual Property

All intellectual property rights associated with our products, website content, and materials are owned by CircusConcepts inc. Unauthorized copying, reproduction, or distribution of our products or website content is prohibited.

8. Force Majeure

CircusConcepts inc. shall not be held liable for any delays or failures in performance caused by events beyond our control, including but not limited to acts of nature, strikes, or governmental actions.

9. Privacy and Data

We collect and handle user data in accordance with relevant laws, including the European Union's General Data Protection Regulation (EU GDPR). For more information, please refer to our Privacy Policy.

10. Right to Refuse Service

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including in cases of violation of these terms and conditions.

11. Other Statements

This disclaimer is valid for the lifetime of the product. This disclaimer is valid in Canada and any other country where the products might be brought, used, or sent.

12. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the province of Quebec, Canada. Disputes arising from product use or related matters are subject to the exclusive jurisdiction of Quebec's courts.
